Pair accused by Harmar police of using man’s missing credit card at Home Depot face felony charges

Harmar police accused two men of using another person’s credit card to make more than $2,500 in purchases from a Home Depot store in Pittsburgh.

Police charged Franklin Grant Rose, 45, of Brackenridge with felony counts of access device fraud and conspiracy to commit access device fraud along with counts of receiving stolen property and conspiracy to receive stolen property.

He was released from custody on a nonmonetary bond. He faces a preliminary hearing before District Judge David Sosovicka on April 24, according to court records.

Police also charged Rose’s alleged accomplice, David Bandurak, 36, no address listed, with a felony count of access device fraud along with counts of receiving stolen property, conspiracy to commit access device fraud and conspiracy to receive stolen property.

A warrant has been issued for Bandurak’s arrest, according to authorities.

Police wrote in a criminal complaint that a Harmar resident reported Nov. 28 that he discovered two fraudulent purchases on his Home Depot credit card that were posted Aug. 8. That was five days after he left for a trip to the Philippines, from which he had just recently returned.

The man told police he did not know whether his credit card was stolen or lost.

Home Depot security officials used information from the transaction to get surveillance video from their East Liberty store, according to police.

Police said the video shows two men driving into the parking lot and entering the store, where the credit card was used to pay $539 for a Ryobi six-piece tool kit, a window air conditioner and two Cokes, according to the complaint.

An officer who viewed the video recognized the two men as Rose and Bandurak, who previously lived in the 2200 block of Freeport Road and were known from previous incidents, the complaint said.

Home Depot security officials were able to track a second purchase for $2,012 made by telephone with the same credit card three hours before Rose and Bandurak allegedly went to the East Liberty store, police said.

Police said Rose and Bandurak ordered two DeWalt cordless tool kits and had them delivered to the victim’s house the following day.
