Greensburg man ordered to prison for rape of unconscious woman

A Greensburg man convicted of raping an unconscious woman and for an attempted sexual assault of another person told a Westmoreland County judge on Monday he wanted to take responsibility for his actions even as he maintained his innocence.

Levi L. Evans, 24, at a nonjury trial in September was convicted by Common Pleas Court Judge Christopher Feliciani of rape of an unconscious victim, indecent assault of another woman and conspiracy.

Feliciani sentenced Evans to serve six-to-12 years in prison and two additional years on parole.

Evans appeared by video from the Westmoreland County Prison after he refused a coronavirus test, the judge said.

During a lengthy statement, Evans told the judge he takes responsibility for his life and regretted how his arrest impacted his family and friends, but insisted the allegations raised against him at trial were not true.

“You don’t know everything that happened in this case,” Evans said.

Police said that on Jan. 18, 2018, Evans and another man visited two women in a Greensburg apartment to smoke marijuana. The women testified at trial they specifically told Evans and friend, Benjamin Davis, in text messages before they arrived that they did not want to have sex.

One woman claimed she awoke to find Evans attempting to have sex with her but fended him off before she lost consciousness.

A second woman testified she passed out after smoking and awoke briefly to find Davis having sex with her. She told the judge she again regained consciousness to find she was being raped by Evans before she passed out.

Evans testified at trial that the women agreed to have sex and denied they were unconscious.

A jury convicted Davis, 24, of Greensburg of the same offenses in 2019. He is serving six to 12 years in prison.
