Irwin man accused of stabbing someone outside bar

A 26-year-old Irwin man is in the county jail on $75,000 bond after police say he fought with two brothers late Monday outside a Main Street restaurant-bar and stabbed one man in the neck.

Joshua James Robison was arraigned Tuesday on charges of assault with a deadly weapon, harassment, possessing instruments of crime, reckless endangerment and two counts of simple assault filed by borough officer Corey Stanoszek.

Robison is accused of stabbing David Kozak, 27, also of Irwin, who was taken by ambulance to Forbes Hospital in Monroeville, just before 11 p.m. Monday, according to police reports.

“David’s still in the hospital. … It’s my understanding he’s going to be fine. But I believe he may need some more surgery, though,” his brother, Dan Kozak, 31, said Tuesday afternoon.

The older Kozak said Tuesday he was still grappling with why he and his brother were assaulted at Brandy’s on Main.

“I was in there with my brother, and he (Robison) was in there, too, and (Robison) was asked to leave earlier,” Kozak said. “He came back in a short while later and sucker punched me from behind, knocking me out on the floor. And when I ‘came to,’ a friend was over top of me … waking me, saying David was stabbed, so I went outside to check on him.”

Dan Kozak also was taken to the hospital by ambulance.

Kozak said Robison fled after the assaults.

Stanoszek reported he spoke with the younger Kozak before he was taken to the hospital.

“David stated that a male wearing a black sweatshirt and hat sucker punched his brother at the bar,” Stanoszek said. “He followed the male outside, and the male pulled out a pocketknife and stabbed him in the neck.”

Stanoszek said he viewed a security video taken inside the restaurant before filing the complaint. He said other witnesses inside the restaurant identified Robison.

When police went to Robison’s apartment on Center Highway, Stanoszek reported “Robison was very cooperative” and admitted he was involved in the incident. Stanoszek said Robison claimed “he was protecting himself.”

He also told police he “felt threatened” by Daniel Kozak earlier in the evening, according to court records.

Before pulling out the pocket knife, Robison told investigators he warned David Kozak he was taking it out “to protect himself.”

“Robison then sliced David and took off to his residence,” Stanoszek wrote.

Stanoszek said Robison said he threw the knife over a hillside while walking home.

An employee who answered the phone at Brandy’s on Main on Tuesday said a manager was not available to comment.

An attorney for Robison was not listed in court documents.

A preliminary hearing is scheduled Jan. 13.
