Latrobe man charged with rape accused of lewdness, assaulting prison guard

A Latrobe man accused of raping a woman hours after his release from the Westmoreland County Prison last week was awaiting arraignment Thursday on new charges of exposing himself to a nurse at the Hempfield lockup and assaulting a prison guard.

Zackery D. Kimmick, 30, was returned to the prison on $250,000 bond Nov. 5 after his arrest by state police in Greensburg on charges of rape, indecent sexual assault, indecent assault and simple assault.

A woman who lives about a mile from the county jail called state police to report she had been raped about 6:30 p.m. Nov. 3 by an unknown attacker, Trooper David Wineland reported. She told police that the man, later identified as Kimmick, knocked on her door and asked to use her phone to call to a relative for a ride.

The victim told troopers that Kimmick raped her, then fled. He was located in Latrobe and arrested Nov. 5 and remanded to the prison, where he had just completed a sentence for a drug-related 2019 conviction in Greensburg.

County Det. James Williams alleges in court papers filed Thursday that, upon his return to the prison, Kimmick allegedly exposed himself to a prison nurse as she was delivering medication to his cell Saturday. He was charged with indecent exposure and open lewdness in that case.

On Sunday, Williams alleges that a prison guard went to check on Kimmick in his cell to make sure he was clothed before medical staff recorded his temperature.

Williams said the guard found Kimmick wrapped in a prison blanket, but Kimmick claimed he was clothed.

“Kimmick was ordered to remove the blanket and he was found to be naked,” Williams said.

Kimmick was ordered to put on his prison clothing, Williams said.

As he put on his clothing, Williams alleges in court documents, Kimmick yelled derogatory epithets at the guard and spit on him through the cell door.

Williams said the guard’s clothing was seized as evidence.

Kimmick is charged with assault by a prison and aggravated harassment by a prisoner for that incident.

According to records, Kimmick has a lengthy criminal record dating back to 2008 with multiple convictions for assault, indecent exposure and thefts.

In 2018, while serving time for exposing himself in Latrobe, Kimmick was charged by county detectives with exposing himself to nurses at the county jail. Court dockets indicate he pleaded guilty in that case and was sentenced to serve up to 23 months.
